Welcome to Modus. Please read these terms before using the app. By creating an account or using Modus you agree to these Terms of Service.
Who we are
Modus is developed by Connor Hepburn and Jason Kilanypitt. We operate from the UK and the US.
Eligibility
You must be at least 13 years old to use Modus. If you are under 18 you need permission from a parent or legal guardian.
Your account
You can sign up with Apple, Google, or email. You are responsible for keeping your login secure and for all activity under your account. If you believe your account has been compromised, let us know through in app support.
Subscriptions and billing
Modus offers paid features through in app purchases handled by Apple. We use RevenueCat and Superwall to manage entitlements. Prices are shown in the app and may vary by region and currency.
Trials, renewals, and cancellations
Subscriptions renew automatically until you cancel. You can cancel at any time in your Apple account settings. When you cancel you keep access until the end of the current billing period.
Refunds
Payments and refunds are processed by Apple. To request a refund, use Apple support. We cannot issue refunds directly.
What Modus provides
Modus helps you log workouts quickly, view progress, and build consistent habits. We aim for high availability but we do not guarantee uninterrupted or error free service.
Health and safety
Modus is not a medical service and does not provide medical advice. Training involves risk. Consult a qualified professional before starting a new program, especially if you have any health condition. Stop any activity that causes pain, dizziness, or shortness of breath and seek medical advice.
Voice input
If you use voice logging, audio is sent to a transcription service via OpenRouter for real time processing. We do not store raw audio. Only the workout data created from your input is saved to your account, consistent with our Privacy Policy.
Your content and rights
You own your workout data and the content you submit. By using Modus you grant us a limited license to process that content for the purpose of operating, improving, and providing the service. You can export your data and you can delete your account at any time in settings.
Acceptable use
You agree not to:
- Reverse engineer or attempt to access the service in unauthorized ways
- Interfere with or disrupt the service or other users
- Use Modus to upload illegal, harmful, or infringing content
- Bypass rate limits, security, or access controls
Third party services
We rely on trusted providers to run Modus, including Supabase for hosting and database, RevenueCat and Superwall for subscriptions, OpenRouter for transcription, and Resend for transactional email. Your use of Modus also follows the terms and policies of these providers where applicable.
Privacy
How we collect, use, and protect data is explained in our Privacy Policy at /privacy. That policy forms part of these terms.
Termination
You can delete your account at any time in settings. We may suspend or terminate access if you violate these terms or if we believe your use poses risk to the service or other users.
Changes to the service and to these terms
We may update features or make changes to Modus. We may update these terms when needed. If we make a material change we will notify you in the app or on our site. Continued use after changes means you accept the new terms.
Disclaimers
Modus is provided on an as is and as available basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non infringement.
Limitation of liability
To the fullest extent permitted by law, Modus and its developers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the service. Our total liability for any claim will not exceed the amount you paid for Modus in the 12 months before the claim arose.
Indemnity
You agree to indemnify and hold Modus and its developers harmless from claims, damages, losses, and expenses arising from your misuse of the service or violation of these terms.
Governing law
These terms are governed by the laws of England and Wales. Courts of England and Wales will have exclusive jurisdiction, except where consumer law in your country gives you different rights.
